This privacy policy (“Policy”) sets forth the terms and conditions (“Terms”) with respect to the collection, use and sharing of personal as well as non-personal data of the end-user (“you” or “user”). The policy prescribes the rights of Koffeetribe Technologies Private Limited (“KTPL” or “we” or “us”) to collect, use and share personal and non-personal data of users as well as stipulates restrictions applicable to KTPL in dealing with such data. By creating an account or registering with KTPL, you agree to be bound by our Privacy Policy, which is incorporated by reference into the Terms of Use of Seller as well as the Terms of Use of Buyer (hereinafter collectively referred to as “Terms of Use”). If you do not accept and agree to be bound by the Policy, you shall not be entitled to access or use the products and services on the Platforms of KTPL.
Unless otherwise specified, the meaning and scope of all the undefined terms in this Privacy Policy shall have the same meaning as indicated in the Terms of Use.
1. Data Collection:
Whenever you access the Platforms for listing, offering for sale, purchasing products and services listed thereon, or otherwise using any of the other features on the Platform, we may collect both personal and non-personal data pertaining to you.
i. Personal data includes data about you which is directly or indirectly identifiable, having regard to any characteristic, trait, attribute or any other feature of the identity, whether online or offline, or any combination of such features with any other information, and shall include any inference drawn from such data for the purpose of profiling. Non-personal data shall include any data which cannot be classified as personal data.
Nature and categories of personal data being collected
a. Basic information: Name, date of birth, gender, permanent address, marital status etc.;
b. Contact information: Mobile number, email address, communication address etc.;
c. information related to payment method(s) used by you (for example: your credit or debit card numbers and other card information, your bank account details, your UPI handle);
d. location information;
e. content of reviews and e-mails to us;
f. the personal description and photograph in your Profile;
g. information and officially valid documents regarding identity and address information, including Permanent Account Number (PAN);
h. credit history information;
i. device log files and configurations, including Wi-Fi credentials, if you choose to automatically synchronize them with your other devices;
j. data collected automatically through usage and access of Platforms by virtue of transactions and interaction with Sellers, feedback, reviews and ratings provided by the Buyer/User.
ii. Source of collection of personal data other than the Platform
KTPL collects personal data from the users through its Platforms either by proactively asking the user or automatically through Content uploaded and or preferences selected by the user on the Platforms. However, KTPL also reserves its right to collect personal data from third parties like social media aggregators. KTPL may also collect information from you through phone, SMS or email. You also provide data when you search, buy, post, participate with KTPL or communicate with customer service. As a result of those actions, you might supply us with such information as: your name; address and phone number; credit card information; the personal description in your profile; and your preferences. The source of information could be such information which is provided by you, automatically provided via uploading of Content on the Platforms or data received through third parties. We may also use device identifiers, cookies, and other technologies on devices, applications, and our web pages to collect browsing, usage, or other technical information.
iii. Nature and category of Non-Personal Data being collected
KTPL may collect non-personal data which includes information not particularly identifiable to a person, but crucial to KTPL. Examples of the information we collect and analyze include: the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information such as browser type and version; operating system and platform. We may also use browser data such as cookies, Flash cookies or similar data on certain parts of our website for fraud prevention and other purposes. During some visits we may use software tools to measure and collect session information, including page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.
iv. Source of collection of non-personal data
KTPL may collect supplemental information via Cookies, Web Beacons, KTPL mobile device applications and from external sources. If you reject or do not accept Cookies, certain functions and conveniences of KTPL website or mobile application may not work properly, however, you do not have to accept Cookies in order to productively use KTPL Platforms. KTPL does not link non-personal information from Cookies to personally identifiable information without your permission and does not use Cookies to collect or store personal health information about you.
v. Information from Other Sources
We might receive information about you from other sources, such as updated delivery and address information from our carriers and logistics partners, which we use to correct our records and deliver your next purchase more easily.
2. Data Processing:
The data collected by us is processed for offering personalized services to you and for several other broad purposes, including but not limited to:
i. Administering account of the user and provide the user with access to particular tools, products and services personalized for the user;
ii. For validating eligibility for and participation in the services offered by KTPL on its Platforms;
iii. Sending personalized emails or secure electronic messages pertaining to your interests, including offers, suggestions for products news, announcements, reminders and opportunities, and provide you with more relevant content and advertisements;
iv. Reviewing and enhancing the quality of KTPL services, and improving the overall experience;
v. To operate, provide, develop, and improve the products and services that KTPL offers;
vi. For purchase and delivery of products and services, KTPL uses your personal information to accept and fulfill orders, deliver products and services, process payments, and communicate with you about orders, products and services, and promotional offers;
vii. To provide functionality, analyze performance, fix errors, and improve the usability and effectiveness of KTPL’s services;
viii. Recommending features, products, and services that might be of interest to you, identifying your preferences, and personalizing your experience with KTPL’s Services;
ix. Compliance with legal obligations;
x. Sharing with third-parties to display interest-based advertisement;
xi. To investigate or defend against any allegation or claim against KTPL.
3. Data Sharing:
Your information is an important part of our business and we highly value the same. We are not in the business of selling your personal information to others, nor do we permit you to sell such information. We share and use the information only when necessary and as described hereunder:
i. Individuals and entities with whom data is shared without notice
a. Subsidiaries or affiliates, suppliers, partners, contractors and sub-contractors of KTPL;
b. Sellers offering their products and services for sale on KTPL Platforms;
c. KTPL employees in order to build and deliver personalized programs for users;
d. Government enforcement agencies and legal authorities if necessary in accordance with applicable law or legal directions;
e. KTPL may partner with other warehousing, logistics and data analytics companies to perform functions on KTPL’s behalf like storage, fulfilling orders for products or services, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing payments, transmitting content, scoring, assessing and managing credit risk, and providing customer service. These third-party service providers may be given access to personal information on a need-to-know basis, but may not use it for other purposes. Further, they must process the personal information in accordance with applicable law.
f. Any other third-parties necessary for back-end support services;
g. KTPL makes available to you services, products, applications, or skills provided by third parties for use on or through KTPL Platforms. KTPL shares your personal information related to those transactions with that third party;
h. Third-party advertising partners may collect information about you when you interact with their content, advertising, and services on the Platforms;
Other than as set out above, you will receive notice when information about you is to be shared with third parties and you will have an opportunity to choose not to share the information.
ii. Liability Limitation in respect of shared data
a. KTPL encrypts data transmitted to and from the App and the Site. Despite KTPL’s efforts to protect your personally identifiable information, secure transmission of information via the internet cannot be guaranteed due to security threats outside KTPL’s control and you acknowledge that transmission is at your own risk. By submitting your personal data, you agree to such transmission. KTPLwill take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy. However, it is made clear that the access, use, transaction, transmission, etc. are done by user of their own volition and risk, and KTPL shall not be responsible and liable in any manner whatsoever.
b. KTPL has no control over the personal data which is shared with Sellers and third-parties under Clause 3(i) above KTPL does not take any responsibility for any unauthorized usage or sharing of such personal data by the Sellers or such third parties. However, KTPL shall assist the user in every way possible in initiating any action against the concerned Sellers for unauthorized usage of personal data of the user.
iii. Data sharing in the event of Merger, Sale, Bankruptcy, or other event
If we are acquired or merged with, any other entity, we reserve the right to assign or transfer any personal data that we have collected; and, for any bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or for any application of laws or equitable principles affecting creditor’s rights, personal data might be transferred or disclosed to third parties. In case of sharing of personal data on account of the reasons set out in this Clause, users will be provided with a notice of such merger, sale, bankruptcy or any other similar event.
iv. Right of the User to withdraw consent
The User may exercise its right to withdraw consent from permitting KTPL from processing or sharing personal data of the user by giving notice of withdrawal to KTPL at [email protected]. KTPL shall not process or share any personal data of the user once KTPL receives such notice from the user. However, KTPL shall not be liable for any information which is already processed or shared before such notice of withdrawal is given by the user. KTPL also reserves its right to terminate the Account of the User on basis of such notice of withdrawal.
4. Disclaimer regarding access to other sites and accounts:
i. KTPL’s website may contain links to other websites and third-party advertisers. KTPL is not responsible for the privacy practices of any other websites or advertisers. We encourage Users to be aware of when they leave our website and to read the privacy policy of every website that collects personal data.
ii. In case a Buyer/Seller/User chooses to create an Account on the Platforms by linking his existing account with another service provider such as Google account, Facebook account, etc., the Buyer/Seller/User shall be responsible for compliance with the privacy policies of such third-party service providers. KTPL shall not be responsible or liable in any manner for the breach of privacy policy of any such third-party service providers by a Buyer/Seller/User, while accessing the Platforms of KTPL through such third-party accounts.
5. Updates and Changes to Privacy Policy:
At any time and from time to time, and without the user’s consent KTPL may unilaterally amend, modify, or change this Privacy Policy, in our sole discretion and without any notice or cause. By continuing to use and access our Platforms after any amendment, modification, or change, you have agreed to be bound by all such amendments, modifications, and changes. Therefore, please carefully review this Privacy Policy on a regular basis to maintain awareness of all amendments, modifications, and changes.
